Are you someone with exceptional abilities who want to work in the United States? Well, for people like you, the EB-2 NIW can be a great option. But what exactly is it?

An EB-2 visa is an employment-based immigrant visa for those individuals who possess exceptional abilities or have highly advanced degrees. If any applicant meets the particular requirements and fulfills the aforementioned prerequisite, they can apply for the national interest waiver (NIW) as a part of their EB-2 petition. It is important to note here that the applicant's employment must prove to be beneficial and must be in the national interest of the United States. Once you acquire an EB-2 NIW visa, you can apply to become a Permanent Resident of the United States.

Eligibility Requirements For EB-2 NIW

In order to become eligible for this particular visa, you need to fulfill the NIW requirements as well as prove your advanced degree or exceptional abilities.

Here is what you need to show to fulfill NIW requirements:

  • Your proposed endeavor is considered to be of substantial merit and national importance. You can prove this merit through various fields like education, health, business, manufacturing, and technology.
  • You must be in a position to process or advance your proposed endeavor. Things like your educational background, skills, experience, etc., will be taken into account in this regard.
  • Evidence that the United States would get benefit on balance to waive the job offer criteria for an EB-2. The "on balance" essentially means that the U.S will be at more advantage by waiving the job offer requirement rather than by not waiving it.

Proving Your Advanced Degree

  • You need to hold a master's degree or a bachelor's degree and at least five years of progressive post-bachelor degree experience to be considered an individual with an advanced degree.

Proving Your Exceptional Abilities

  • A certified academic transcript is demonstrating your possession of a degree, diploma, certificate, or other comparable awards from a college, university, school, or other higher educational institution in the subject area of exceptional ability.
  • Letters stating that you have worked full-time for a company for at least ten years.
  • Certification for a certain profession or occupation or a license to practice the profession
  • Evidence that you are paid a salary or other form of compensation for exceptional services.
  • Membership in professional associations.
  • Records showing that peers, governments, professional associations, or businesses have acknowledged your accomplishments and great contributions to your industry or field

What Is The Processing Time?

When you submit an NIW, you will get your I-140 receipt notice in 2–3 weeks. After that, regular processing can take anywhere between 5 and 17 months for USCIS to make a decision. Applicants also have an option to expedite their application and hear a decision within 14 calendar days through premium processing. A notice of approval will be sent to you via mail or the online USCIS portal.
