Benefits of H-1B Visa

Benefits you can have after acquiring an H-1B visa

There is no denying that the H-1B visa is one of the most popular visas compared to other non-immigrant visas provided by the U.S Citizenship and Immigration Services

It is because it offers various benefits to U.S employers and foreign workers.

Following are some of the benefits a U.S employer can get:

1. Fill the labor shortage:

Many employers face the issue of labor shortage. This is because they are located where they can not access highly qualified workers.

Having an H-1B visa can solve this issue as employers can hire top-class workers from foreign countries. These workers are usually willing to work at the employer's location.

2. Compete Globally:

You can compete globally by hiring H-1B employees. This will further boost your competitiveness abroad, providing you an edge over other employers.

This is indeed the need of the hour as today's market is becoming tougher and more competitive over time.

Below mentioned are a few of the benefits a foreign worker can get:

  • Longer duration of stay: You can stay up to 3 years and can further extend your visa as well.
  • Everyone can apply: No matter where you belong, you can apply for this visa.
  • Flexibility: You can easily change your employer. Also, you can work for various employers simultaneously.
  • Can get PR: Under an H-1B visa, you can apply for permanent residency.

Eligibility of H-1B Visa

What is required to be eligible for this visa

Following are certain requirements that you and your employer need to fulfill:

  • Your bachelor's degree proof in a particular field
  • Job offer from U.S employer strictly for the role that needs special knowledge
  • Proof from your employer that there is a shortage of qualified U.S. applicants for the particular field
The Process of H-1B Visa

A complete process of H-1B Visa

The process for an H-1B visa is a bit complex. Your employer needs to file a petition on your behalf to start the process.

First, for certification, they will be required to submit a Labor Condition Application to the Department of Labor (DOL).

Next, after the LCA is certified by DOL, your employer will file Form I-129. They will need to file this form along with LCA to USCIS. Additional documents and fees may also be required.

After that, you will wait for the approval of Form I-129. Getting approval means you will have two options. If you are in the U.S, you will wait for your H-1B visa status to get active.

If you are outside the U.S, you will be required to apply for consular processing, which involves filling the Form DS-160. You will also need to schedule an interview at your nearest consulate or U.S embassy.
